Terms of Use

1. Agreement 

    i.     Thank you for visiting MLAW.GOV.SG/MINLAW.GOV.SG, the official             website of the Ministry of Law of the Republic of Singapore, and any             applications or services related to or linked to or from this website             (henceforth collectively known as "the Site"). The Site is owned and             operated by the Government of the Republic of Singapore c/o the             Ministry of Law (“MLAW”). 

    ii.     Access to the Site is governed by the terms and conditions of use as             stated below (“Terms of Use”). By accessing and using the Site, you             shall be deemed to have accepted and agreed to be legally bound by             these Terms of Use. If you do not accept or agree to any of these             Terms of Use, please leave the Site.

    iii.     These Terms of Use may be changed from time to time. All changes             to the Terms of Use will be incorporated directly onto this page, and             your use of this Site after such changes have been incorporated will             constitute your agreement to the modified Terms of Use and all of the             changes.

    iv.     References to “the Site” in these Terms of Use shall include the Site             in its entirety as well as its individual pages, and shall include any             services offered by MLAW on the Site. 

2. Access to the Site

    i.     The accessibility and operation of the Site relies on technology outside             of MLAW’s control. MLAW does not guarantee continuous             accessibility or uninterrupted operation of the Site.

    ii.     MLAW reserves the right to temporarily suspend or shut down the Site             for system maintenance or for such other purpose as MLAW may             require, as and when necessary.

    iii.     MLAW reserves all rights to deny or restrict access to this Site to any             particular person or to block access from any Internet address to this             Site or any part thereof, at any time, without ascribing any reasons             whatsoever.

    iv.     Any transactions (including the use of any electronic services             (“E-Services”)) which you carry out on this Site shall be subject to             such additional terms and conditions as MLAW finds necessary.             These additional terms and conditions shall be brought to your             attention at the time of your transaction, and by carrying out your             transaction you shall be deemed to have accepted and agreed to be             legally bound by the additional terms and conditions.  

3. Reliance on Information on the Site

    i.     MLAW provides the Site as a general information source only. The Site             should not be taken as giving professional advice, and may not cover             all the relevant information on a particular issue. Before relying in any             way on the information on the Site, you should do your own checks             and/or obtain the necessary professional advice on your particular             issue.

    ii.     MLAW may modify or discontinue any information or features that             form part of the Site at any time, with or without notice to you, and             without liability.  

4. Security

    i.     Where appropriate, MLAW uses available technology to protect the             security of communications made through the Site. Notwithstanding             the above, MLAW does not accept liability for the security,             authenticity, integrity or confidentiality of any transactions or other             communications made through the Site. You carry out any such             transactions or communications at your own risk. 

    ii.     Internet communications may be susceptible to interference or             interception by third parties. Despite MLAW’s best efforts, MLAW             makes no warranties that the Site is free of infection by computer             viruses or other unauthorised software. 

    iii.     You should take appropriate steps to keep your information, software             and equipment secure. 

    iv.     This includes clearing your Internet browser cookies and cache before             and after using any services on the Site. 

    v.     You should keep your passwords (including your SingPass and other             designated passwords) confidential and secure. MLAW will not             request for your passwords by e-mail or other modes of             communication, other than as an authentication key for entry into the             Site and for services offered by MLAW therein.

5. Links to this Site 

    i.     This Site contains links to non-Government websites which are not             maintained by MLAW (“private website”). MLAW is not responsible or             liable for the availability or the contents of any private website linked             to or from the Site.

    ii.     MLAW is not liable for any damages or loss of any kind caused as a             result (whether direct or indirect) of the use of any private website,             including but not limited to any damage or loss suffered as a result of             reliance on the contents contained in or available on the private             website.

    iii.     Links to other websites are provided in the Site as a convenience.             Under no circumstances shall MLAW be considered to be associated             or affiliated in whatever manner with any trade or service marks,             logos, insignia or other devices used or appearing on websites to             which the Site links to.

    iv.     Except as set forth below, caching and links to, and the framing of             this Site or any of the content therein is prohibited:

            a. You must make a specific request for, and secure permission from             MLAW prior to linking to, or framing, any page or part of this Site, or             engaging in similar activities. MLAW reserves the right to impose             conditions when permitting any hyperlinking to, or framing of any page             or part of this Site. 

            b. Your linking to, or your framing of this Site or any of the content             constitutes acceptance of these Terms of Use, including any             subsequent changes or modifications to these Terms of Use. If you             do not accept the Terms of Use as may be changed or modified from             time to time, you must discontinue linking to, or framing of this Site or             any of the content.

            c. Under no circumstances shall MLAW be considered to be             associated or affiliated in whatever manner with any trade or service             marks, logos, insignia or other devices used or appearing on websites             that link to this Site or any of the content. 

            d. MLAW reserves all rights to disable any links to, or frames of any             site containing inappropriate, profane, defamatory, infringing, obscene,             indecent or unlawful topics, names, material or information, or             material or information that violates any written law, any applicable             intellectual property, proprietary, privacy or publicity rights. 

            e. MLAW reserves the right to disable any unauthorised links or             frames to the Site and disclaims any responsibility for the content             available on any other website reached by links to or from this Site.

6. Intellectual Property

    i.     The materials located on this Site including the source code, data,             pages, documents and online graphics, audio and video media, and             information and software programs (“the Contents”), are protected by             copyright, trademark and other forms of proprietary rights. All rights,             title and interest in the Contents are owned by or licensed to MLAW.

    ii.     Except as otherwise provided, no part of the Contents may be             reproduced, transmitted, distributed, incorporated in printed or             electronic form or used in any way without the prior written approval of             MLAW. Approval should be sought by sending a request through this link.

    iii.     You may make copies of the text for the purposes of applying for             licences, permits and registrations on the Site. You may also print             out, and copy portions of the text in accordance with the provisions of             the Copyright Act.

8. Disclaimers and Limitation of Liability

    i.     While every care is taken by MLAW in providing the Contents and             services on the Site, MLAW does not make any warranty or             representation whatsoever and hereby disclaims all express, implied             and statutory warranties of any kind to you, whether arising from             usage or custom or trade or by operation of law or otherwise, including             but not limited to the following:

            a. That your use of, or access to the Site and its services will be             uninterrupted, timely, secure, free of bugs, free from human             tampering, free from viruses or other malicious, destructive or             corrupting code, programme or macro, free from transmission errors or             otherwise error-free or that there will not be any defects or deficiencies             in the Site;

            b. As regards the security of the Site or the security of your             information captured in or made available through applications for             licences, permits or registrations at the Site; and

            c. As to the accuracy, completeness, reliability, non-infringement of             third party rights, title, merchantability, satisfactory quality and/or             fitness for any particular purpose of the Contents of the Site.

    ii.     MLAW shall not be liable for any damages, losses, compensation,             penalty, expenses or costs whatsoever (whether direct, indirect,             special or consequential damage or economic loss and whether             foreseeable or not) incurred on account of or arising from:

            a. Using, visiting or relying on any statements, opinion, representation             or information provided through the Site;

            b. The access to the Site or use of any services offered on the Site;

            c. Any inaccuracy or incompleteness in, or errors or omission in the             content of the Site;

            d. Any delay or errors in operation or transmission of the Site arising             from communications failure, internet access difficulties or             malfunctions in equipment or software; 

            e. Use or access to the Site or any other website linked to the Site or             in connection with any failure of performance, error, omission,             interruption, defect, delay in operation or transmission, computer virus             or line or system failure; and 

            f. Actions or omissions of any person who access or use the             applications at the Site or obtains any information obtained directly or             indirectly through the Site,

regardless of whether MLAW has been advised of the possibility of such damages, loss, compensation, penalty, expenses or costs.

9. Applicable Law

    i.     Use of the Site and these Terms of Use and all its subsequent             variations shall be subject to, governed by, and interpreted in             accordance with the laws of the Republic of Singapore, and you             hereby agree to submit to the exclusive jurisdiction of the Singapore             courts in the determination of any dispute arising in connection with             the use of the Site.
